Justice Smith raised concerns over the apparent contradictions present in Mostaque's submissions, noting, 'These documents hint at the possibility that Mr. Mostaque's testimony is either wrong or lacking; at the very least, they indicate conflicting evidence.'

Judge Smith highlighted previous comments made by Stability AI’s CEO during interviews and media appearances, emphasizing the need for a deeper inquiry. She remarked that, due to 'unresolved questions,' a comprehensive trial is crucial and 'further disclosure could reveal that Mr. Mostaque's evidence holds up.'
