Hermès Officially Bans the Creator Behind MetaBirkins NFTs

Rothschild has been ordered to compensate Hermès with $133,000 in damages and to transfer ownership of the domain name, 'metabirkins.com.'
The court filing strictly prohibits Rothschild from marketing or selling MetaBirkins NFTs, as well as from creating any new ones.

The French luxury giant Hermès has firmly established a ban on the creator of the MetaBirkins NFTs, Mason Rothschild.
MetaBirkins is a collection consisting of 100 non-fungible tokens (NFTs) that were created on the Ethereum blockchain. Launched in December 2021, this unusual collection is the work of digital artist Mason Rothschild, whose actual name is Sonny Estival. Hermès is known for its exclusive bags made from exotic leathers, which inspired the creator to focus on alternative materials, such as faux fur, for this NFT series.
In the same month that MetaBirkins debuted, Hermès asserted that these artworks represented an infringement of its intellectual property rights. Subsequently, in January 2022, the luxury brand proceeded with legal action against Rothschild. After a lengthy legal confrontation spanning a year, Hermès prevailed in February. won A federal court in Manhattan mandated that Mason Rothschild cease promoting his NFT collection on social media platforms and his website. On June 23, a judge from the Manhattan federal court issued a permanent ruling against the creator of the MetaBirkins NFT series, forbidding any further sales or promotions.
Following this, in March, Hermès requested Judge Jed Rakoff stated: \"Hermès successfully demonstrated that Rothschild intentionally deceived consumers into believing that the luxury brand was endorsing his products.\" filing Along with the triumph in trademark rights, Hermès secured $133,000 in damages. Additionally, Rothschild was instructed to transfer the domain name of the project's website, 'metabirkins.com,' to Hermès.
The court ruling prohibits Rothschild from actively marketing or selling MetaBirkins NFTs, and he is also barred from minting any new artworks related to Hermès. Furthermore, Rothschild cannot offer any advantages, like airdrops, to nonexistent holders, as this could drive NFT purchases.
It's noteworthy that while the creator and existing holders can maintain possession of the digital artworks, Rothschild is mandated to distribute the court’s order to NFT holders.
